Payments: All amounts have to be paid within 30 days after the orderform date. All payments can be executed in cash or with a bank transfer to the account mentioned on this orderform. Every complaint or problem concerning our orderforms has to be communicated within 8 days after the reception of the orderform. After this time has elapsed, the orderform will be regarded as accepted. In case of non-payment on the expiry date, without necessary proof of default, a legal interest of 12% a year starting from the orderform date will be added to the total amount. In addition, in case of illegitimate delay of the payment, a compensation for additional administrative costs of 12% of the orderform amount with a minimum of 50 euros and a maximum of 2 000 euros will be added, without necessary proof of default. Liability: All Liability on the part of Bizzbone BVBA within the framework of the agreement in hand, and insofar as no clauses to different effect have been included, is expressly limited to the repairs of the damage which was directly caused to the Customer, insofar as this damage was the result of gross remissness or intent on the part of Bizzbone BVBA. This Liability shall never amount to more than the sum total of the fees Bizzbone BVBA has or stands to receive in payment of the relevant order, to a maximum of 100,000.00 EUR. The obligation to protect the System against any non-intentional, unauthorised access both directly or through a network, rests with the Customer.
Force Majeure: In case of temporary or permanent force majeure, Bizzbone BVBA is authorised to cancel the agreement without legal intervention with a written statement. The customer has no right on compensation, nor the right to cancel the agreement.
Applicable law: The origin, execution and interpretation of the agreement in hand shall be governed by applicable Belgian law. The district courts of Tienen are deemed competent to hear all and any disputes which may arise between the parties regarding the agreement. If Bizzbone BVBA so wishes, the dispute shall be priory submitted to independent arbitration.
